Scenario:
My opponent has a face-up, atk position Gorz, and a face-up def position Treeborn Frog.
I have a face-down def position GK Spy.
My opponent attacks Spy with Gorz, I special summon Recruiter in face-up atk position via Spy's effect.
My opponent then activates Enemy Controller, tributes Gorz, and takes control of my GK Recruiter.

Can he attack with Recruiter? Can he activate Enemy Controller during the battle phase at all?

Perfectly legal play. You are back at the Battle Step after leaving the Damage Step, so Quick-Plays like Enemy Controller can be used.
